Definition

Under normal estate law If the beneficiary (person receiving the gift )who passes away prior to the testator (the writer of the will) the gift will lapse( the gift returns to the will residuary). Lapse statute or Anti Lapse statute that allows the heirs of a beneficiary who passes away prior to the testator (the writer of the will) to take possession of the testamentary gift that was originally intended for the beneficiary.
