Constructive Eviction |
Definition |
The landlord legally evicted the tenant without following state eviction rules and procedures. Constructive eviction arises when the action of the landlord compels a tenant to leave the premises either does something or fails to do something that he has a legal duty to provide. e.g. the landlord refuses to provide heat or water to the apartment, , turning off the drinking water, blocking the driveway. A tenant who is constructively evicted may terminate the lease and seek damages. |
