Change Of Circumstances |
Definition |
A reason for a court to amend an existing order for the payment of alimony and/or child support. In most cases, in order to seek a change in the support amount, the person seeking the change must show that circumstances (such as the employment, health, or an increase or decrease in the income of the payor) have changed from when the order was made. For example if the ex-husband's income is substantially increased or the ex-wife becomes ill and cannot work, the judge may order the ex-husband to pay her more. Remarriage of a spouse who is receiving alimony automatically terminates the alimony order, unless there is a special provision that it continue, which is rare. |
